Purposes include customer onboarding, payment processing, project updates, marketing (where permitted), and support.

We implement technical and organizational measures to protect data against unauthorized access, alteration, disclosure, or destruction. All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties

Subject to PDPL and applicable exemptions, Users may request: access, correction, erasure, restriction, objection, withdrawal of consent, and portability (where feasible). To exercise rights, contact privacy@tarafdevelopment.com. We may request reasonable verification.

Where data is transferred outside the UAE, we will ensure appropriate safeguards compliant with PDPL (e.g., adequate jurisdiction, contractual clauses, or other permitted mechanisms).

We retain personal data only as necessary for the purposes collected and to comply with legal/regulatory obligations (e.g., AML, tax, accounting), after which it is securely deleted or anonymized.

By accessing or using the Website, you agree to these Terms & Conditions:

4.1 Scope of Services

The Website provides marketing information, online reservation functionality (where available), customer support, and electronic payment collection. All property sales are subject to separate binding instruments (e.g., reservation form, sale and purchase agreement, SPA, escrow protocols, Oqood registrations, and applicable regulations).

4.2 No Reliance & Marketing Disclaimer

All images, renderings, floor plans, dimensions, finishes, amenities, and timelines are illustrative and subject to change due to design development, regulatory approvals, construction tolerances, supplier variations, and availability. Nothing on the Website constitutes an offer, representation, warranty, or contractual commitment by Taraf unless expressly stated in a signed agreement.

4.3 Intellectual Property

All Content (including trademarks and materials) is the exclusive property of Taraf Development LLC or licensed to us. No license is granted except limited, revocable, non-transferable permission to access the Website for personal, non-commercial purposes. You shall not copy, adapt, reverse engineer, scrape, frame, or use Content without prior written consent.

4.4 Acceptable Use & Prohibited Conduct

You shall not: (a) engage in unlawful, fraudulent, or deceptive activities; (b) introduce malware or interfere with Website functionality; (c) circumvent security or access accounts/data not belonging to you; (d) perform automated scraping; (e) infringe IP or privacy rights; (f) use the Website for unsolicited communications; or (g) violate applicable laws or third-party rights.

To the maximum extent permitted by law, Taraf shall not be liable for: (i) indirect, incidental, special, or consequential loss; (ii) loss of profits, revenue, or data; (iii) reliance on Website Content; or (iv) delays, failures, or errors arising from networks, payment gateways, or force majeure. Nothing excludes liability for fraud or willful misconduct.

4.8 Indemnity

You agree to indemnify and hold harmless Taraf, its affiliates, officers, employees, and agents from claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or violation of laws/third-party rights.

4.9 Suspension & Termination

We may suspend or terminate access/accounts without prior notice for violations of these Terms, risk of fraud, security concerns, or regulatory requirements. We may remove or modify Content at our sole discretion.

4.10 Governing Law

Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE

4.11 Jurisdiction & Dispute Resolution

Disputes may be referred to DIFC-LCIA Arbitration (seat: DIFC, language: English, one arbitrator) upon mutual written agreement.

4.12 Unilateral Amendments

Taraf reserves the absolute right to modify, amend, or update the Website, policies, and these Terms & Conditions at any time without prior notice. Continued use of the Website after publication constitutes acceptance of the revised terms. For material changes, we may (but are not obliged to) provide a notice banner or email.

5. Delivery & Shipping Policy

5.1 General‍

Taraf does not deal with or provide services/products to OFAC-sanctioned countries in accordance with UAE law.

5.2 Timelines & Charges‍

Delivery (whether digital confirmations, receipts, or physical brochures) follows timelines and charges disclosed at checkout or on the relevant page.

6. Accuracy of Information

You hereby warrant that all information provided for the purpose of completing the payment—including customer details, payment references, invoice numbers, and transaction amounts—is true, complete, and accurate. The Platform shall bear no responsibility for losses, delays, or rejections arising from inaccurate, incomplete, or misleading information submitted by the User.

7. Transaction Confirmation

A payment confirmation receipt will be issued electronically upon successful processing of the transaction. Failure to receive such confirmation does not automatically imply that the transaction was unsuccessful. Users are responsible for verifying the status of their transactions and reporting discrepancies promptly.

8. Payment Terms

8.1 Methods‍

We accept payments online using Visa and MasterCard credit/debit card in AED (or any other agreed currency). The logo of the accepted cards is to be mentioned on their Home page and on their Payment check out page.

8.2 Authorization & Fraud‍

You authorize the Payment Gateway to debit the specified amount. We may use fraud monitoring tools, require additional verification, or decline transactions at our discretion.

8.3 Chargebacks‍

Where a cardholder initiates a chargeback, you remain liable for amounts validly due and any associated fees if the transaction was authorized and services delivered per the applicable terms.

8.4 Taxes & Fees‍

Prices may include taxes; any additional taxes, duties, or bank fees are your responsibility unless otherwise stated.

8.5 No Storage of PANs‍

We do not store full card numbers (PAN), CVV, or magnetic stripe data. Tokenization and secure gateways are used.

8.6 PCI DSS‍

We integrate with payment service providers aligned with PCI DSS requirements. You acknowledge that payment data is processed by third-party gateways under their security protocols.

9. Refund/Return Policy

9.1 General‍

Refunds will be done onlythrough the Original Mode of Payment.

9.2 Conditions‍

Eligibility, timeframes, and deductions (e.g., administrative fees) are specified on the relevant product/service page or reservation terms. Reservation fees for property bookings may be non-refundable, unless stated otherwise in the specific reservation or SPA.

9.3 Process‍

We may assign, novate, or subcontract any rights/obligations under these Terms to affiliates or service providers. You may not assign your rights without our prior written consent.

16. Severability

If any provision is invalid, illegal, or unenforceable, the remaining provisions continue in full force. Invalid provisions are replaced with valid ones that most closely reflect the original intent.

17. Waiver

No failure or delay in exercising any right constitutes a waiver. A waiver must be in writing and signed by an authorized representative of Taraf.

18. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any specific reservation/payment terms, constitute the entire agreement for Website use and supersede prior communications in relation to Website access and online payments. Property transactions are governed by separate binding instruments.

19. Language

In case of discrepancies between translations, the English version shall prevail unless UAE law mandates otherwise.
